ENFORCEMENT OF NON CONVENTIONAL ARBITRAL AWARDS

Abstract

Arbitration is one of the oldest system of alternative dispute resolution to the traditional state administered court litigation. The role of arbitration as an alternative to state controlled court system is well recognized. Its essence is that parties choose a third party whose decision on the dispute is binding on them. Arbitration is a mechanism for resolution of disputes which take place usually in private, pursuant to an agreement between two or more parties, under which the parties agree to be bound by the decision to be given by the arbitrator according to law or, if so agreed other considerations, after a fair hearing such decision being enforceable at law. In Indian Arbitration and Conciliation Act there are  separate chapters for enforcement of arbitral awards and as foreign arbitral awards but there is no measure for enforcement of non conventional awards. So in this paper an attempt has been made to focus on enforcement mechanism of non conventional awards.
